U.S. Gambling Industry Sounds Alarm Over Hidden Tax Clause in Trump’s One Big Beautiful Bill Act

(Las Vegas).- The U.S. gaming community is raising concerns over a little-known provision tucked into the nearly 900-page One Big Beautiful Bill Act, signed by President Donald Trump. Set to take effect on January 1, 2026, the new law will cap gambling loss deductions at 90%, sparking backlash from professional players and industry experts.
Under current tax rules, gamblers—both professional and casual—can deduct 100% of their losses against winnings, paying taxes only on net profits. The upcoming change will force players to pay taxes on “phantom income,” with Congress estimating an additional $1 billion in revenue over the next decade.
The impact could be severe for high-stakes professionals. For example, a player who wins $3 million but loses $2.8 million would be taxed on $480,000 they never actually pocketed. Poker icon Phil Galfond and legal expert Nelson Rose warn this could lead to business closures and a migration of players to countries with more favorable tax laws.
Casual bettors and platforms like Kalshi.com—classified outside traditional gambling—will remain unaffected. Notably, Donald Trump Jr., a strategic advisor to Kalshi, has publicly supported its expansion.
Industry leaders fear the reform could drive players toward unregulated markets, undermining the record $72 billion in commercial gaming revenue reported in 2024. As the law reshapes the fiscal landscape, it may also redefine the future of U.S. gambling.
